By purchasing any of our products you agree to the terms & conditions outlined on this page.

Please note our delivery times for all designer items are approximately 14 - 28 days for delivery (which will be longer during the Christmas period). We cannot be held responsible for items that are delayed in transit due to customs and Royal Mail etc.

Google Checkout - We now accept payment by Google Checkout. This is a fast simple and secure way of paying via credit or debit card for transactions made on our website. When you put your item into the 'add to cart' you will be prompted to either 'go to checkout' or go through 'google checkout'. If you wish to pay by this method please click on the Google checkout logo, which will take you through the payment process.

LUUP Credit Card Processing - LUUP is a fun and simple way to pay. You can send money and pay for goods online or using your mobile phone, it is quick simple and secure to use. For more details on LUUP and to sign-up please visit www.luup.com

Refunds:
If you change your mind about your purchase, please return the unused goods to us with the required returns form within 7 days, and we will offer you an exchange or a credit note. This does not affect your legal rights, including your right to claim a refund, replacement, repair and/or compensation where the goods are faulty or misdescribed. Please email us to arrange a return.

We do offer dropshipping of our products. Simply List our items including any descriptions and pictures from our website onto yours and when you sell an item, purchase from us (keeping the profit for yourself) and we will send out the items straight to your customer! Simple! Just quote 'Dropship Order' in the notes box during checkout.

Please note: If you select an item that states on the item page when bought that it is out of stock we will automatically send out the closest item in comparison to the one you have selected.

Gifts and Costume Jewellery:
All giftware and costume jewellery (apart from designer items) in stock will be posted within 48-72 hours. While we endeavour to hold as much stock as possible, there are times when we sell out of a particular item and your order may take 7-10 days to get to you. If need an item very quickly and can not wait, please email us for availablilty.

'Tiffany' Inspired Items:

DISCLAIMER: Desire Gifts is not representing, affiliated with, associated with, or sponsored by, Tiffany or their copyrighted products. We are NOT REPRESENTING our products to be original. While many of our products are similar to them, they do not violate any copyright laws. Any reference to a Tiffany is made only for comparison.

We do not represent our products to be original nor do we represent that they are exact copies, therefore they do not violate any copyright laws. We simply ask consumers to compare quality and price of the mentioned name brands to ours. Any reference to brand names, "inspired by" or "compare to" are made strictly for comparison of prices and style. Changes to the item and hallmarks mean that they are not exactly the same as the original item, if you require the original item please see the Tiffany website.
Please note that designer jewellery can take upto 28 days to arrive. You may only cancel your order with us within 3 days from us receiving payment from you as all items are ordered from our warehouse abroad and sent within this time (so they may already be in transit).

Offers:
We reserve the right to change or discontinue offers and discounts without prior notice to our customers.

Payment:
Payment must be made by the methods offered in the shopping cart. The methods we accept are shown below. Please note that we can only accept payment via Google Checkout, LUUP and www.moneybookers.com for international customers. All personal cheques must be in pound sterling.

Off Line Payments:
You may also pay by cheque, postal order and bank transfer.
Goods will only be despatched upon confirmation of receipt of cleared funds from our bank.

Shipping:
Shipping is usually made within 5 business days of payment (not for designer items), however, we do not guarantee delivery dates.We will not be held responsible for items that are lost or damaged during transit. It is up to you as the customer to purchase insurance if you feel it is needed.

PLEASE ALLOW 3 WEEKS FOR DELIVERY OR SIX WEEKS IF WE HAVE TO MAKE YOUR ITEM OR YOU ASK FOR A CUSTOMISED ITEM.

PLEASE ALSO ALLOW 14 - 28 DAYS FOR DELIVERY OF STERLING SILVER & DESIGNER JEWELLERY. We cannot be held responsible for items that are delayed by customs and cannot 100% guarantee a delivery date for these items. The special delivery option for designer items is for the insurance on the parcel and NOT to speed up the time of delivery.

Who is responsible for any Customs Fees & Import Duties:
When shipping internationally your order may be subject to import duties and taxes, which are levied once your package reaches your country. Funky Town Gifts does not collect duties and taxes and cannot predict what your particular charges may be. If you do incur these additional charges, they must be rendered in order for your package to clear customs.

Please note:

* All sales are final.
* If your customer decides to return the goods to you as an unwanted item, Funky Town Gifts will not accept unwanted goods back for credit. You will need to make arrangements with your customer for the return and refund.
If require a copy of your invoice to accompany the goods we would request that our order number be incorporated within your paperwork in a field pre-notified by yourselves.
For purchase orders that you request to ship via courier/ all over sea’s consignments – please note a contact telephone number must be provided.

Purchasing from Funky Town Gifts:
To purchase from us you must be over the age of 18
By submitting your order you are offering to buy the goods at the prices and terms stated and are allowing us to use your details for the purpose of supplying goods incl. Passing your details onto our/ your nominated carriers and other third party subcontractors. We will not use your details for any other purpose without your prior written consent.
We are not obliged to supply the goods to you until we have confirmed order acceptance to your order request.
The contract to supply your order is made only at the time that you receive our automated email confirming that the goods have been despatched.
You do not own the goods until payment has been received in full.
You must ensure that all details required are correctly filled in on the order form BEFORE submitting, including email address, full postcode & payment details etc.
ALL TRANSACTIONS are processed in pound sterling (GBP).
Product costs and total costs shown in Euros on this site are for your guidance only. The exchange rate for Euro guidance is calculated using the xe.com site as a daily exchange guide.

Prices
All goods are priced exclusive of VAT at 17.5%.
All prices and offers are subject to change and availability.
If we discover an error in pricing of the goods in your order, we will inform you as soon as possible, using the contact details you supply us, and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you within seven days, we will cancel the order. In the event of an order being cancelled, any payment made for the goods will be refunded in full.
All products are available while stocks last. If we are unable to supply a particular item that you have ordered, we will notify you as soon as we can after receiving your order.
You, the purchaser is liable for any local country taxes/ duties should these arise.
Import Duty varies from country to country, if you are unsure, please contact your local Government Importation Office.

Funky Town Gifts takes privacy and security rights seriously. During the course of trading, we may gather personal information which is kept strictly confidential.

Funky Town Gifts will not release personal telephone or address details to any third parties, except in the following situations:

* If required by a courier delivery agent in order to contact you regarding your delivery
* As required by law and requested by the court
* We will also ensure that any ex-directory numbers given are not used in any further correspondence. We may send random marketing emails to personal email addresses from ourselves only, however if you wish not receive emails from us then please email us with your request.

We do use cookies to store address information on the order form, however we do not store any sensitive data in a cookie.

Our Liability
We will not be held liable for any losses resulting from your use or the inability to use our website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances that are beyond our control.
We will not be responsible for loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.
You will be responsible if you use this website in breach of these terms of use and will reimburse us for any loss that you cause to us as a result of your misuse.
We make no promise that our website will be uninterrupted or entirely error free. Because of the nature of the Internet, the shopping online service is provided on an as is and as available basis. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

All our customers’ transaction details remain confidential (in accordance with the Data Protection Act 1998).
